All those ppl who received receipts can you please give us 3 pieces of data
1) Was there an LUD update on ur I-140 (Last Update Date on the USCIS.gov website)
2) What Service center did you guys file in?
3) Do your recept numbers start from LIN or SRC?
1)No LUD for me.
2)Filed in Nebraska,on July 02 at 11am.Signed by C Uhrmacher,
3)Receipt numbers recd for self and spouse for I485.I765,I131.Receipt dated 08/08/2007.All numbers start with LIN.
When I check my status online it shows a LUD on 8/12/2007 which is a sunday.

I agree with WendyZhu. I don't think that the IOs would share such sensitive information. They very well know that this information could spur up huge debates on blogs like it already has. At the same time the IO could be tracked down and could lose his job because of this. There is certainly something fishy here.
Relax guys and gals , don't stress over these rumors. We already have sleepless nights because of the erratic processing by USCIS and these rumor-mills just increase our stress level.
Just think of this - what's the worse that could happen ? It's already happening - people with 2006 PDs and Aug '07 RDs are getting approvals while 2004 PDs and July 2 RDs are still waiting.

Did anyone has got their names changed from the new york embassy.
scenario is as follows:-
Given name has both first name and last name
surname is empty.
I want to get it changed and on the embassy website, they are asking for an affidavit.
Anyone who has gone throught this process can they please share their experience and information.

filings today as the counting of H-1B petitions received on April 2 and 3 continues. On April 3, USCIS
announced that it had received enough petitions to meet the congressionally mandated cap for fiscal year
2008 (FY 2008) and that it would conduct a computer-generated random selection of cap-subject petitions
filed on Monday (April 2) and Tuesday (April 3) to determine which cases would be accepted for processing.
As of April 9, USCIS has determined that approximately 119,193 of the H-1B petitions received on April 2
and 3 are subject to the FY 2008 congressionally mandated cap.
USCIS received on April 2 and 3 a total of approximately 12,989 cases requesting an exemption from the FY

USCIS do have some checks and balances for the subst labor cases, so its not a staright approvals for the lab subst cases. their might be a possibility few lucky ones get off the hook, but overall USCIS can weed out the dubious/fraudulent employer petitions.
Sub labor is not the only reason guys, its just the country cap which is limiting india EB-3 and EB-2. Most of the H1Bs like us coming to us ends up applying for GC, now look at the number of H1Bs coming each year from india and the total number of GCs available for india. Their is a huge gap in these numbers, so unless they remove the country cap or recaptured unused VISA numbers from the past years, we dont see any relief.
Please donate to IV and help lobbying for the admin fixes or the laws which going to help us in the long run.

by concentrating energy on spilled over milk, why not work towards recapturing unused visa numbers? It has been done in past successfully. It is in huge numbers, guess around 300-400K or so.
while wasting energy on 2-3K or may be 5K lc sub cases will do no good for everyone. visa recapture will solve problems for most of the community.

Hopefully desi3933 can come by and perform a reality check on this proposal.
An interesting idea to say the least. Out of box suggestion.
However, there are few things, from legal point of view, it needs to overcome. I will post my detailed comments this afternoon.

The link you have posted seems to talk about allowing to file for 485 even though the priority date may not be current.
It would be difficult to combine both the proposals. The combination would mean that everyone would enjoy the benefits of being allowed to continue living and working in the country with no annual limit. Which basically means no control of immigrants.
I am not in anyway opposing this. But we need to look at it based on how the decision makers are going to perceive it.
I feel what is being proposed by 'realizeit' is realistic and will not hamper the annual limits. It would be good if someone has contacts with the AILA and can persue the matter as a coalition effort.

From february 2004 (expiry date of i-94 card) until april 1994 it looks like you accrued unlawful presence. The unlawful presence stopped when you filed the 485.
The unlawful presence was wiped out when you left and re-entered usa (the 3 year bar didn't kick in because the unlawful presence was less then 180 days).
You will be fine.
Just be truthful that you filed 485 before; you had divorce and all the employers that you worked with. Only thing they can get you on is if you try to embelish or hide things even though they were forgiven when you left and re-entered.

In my I-485 packet he has included a rider (part 3, I believe) stating that a I-485 was filed earlier and withdrawn by me and has included evidence documents to that effect.

My PD will be current with sept 09 bulletin. I was about to file for AC21. what should i do now:
1. File for AC21 and then if they raise RFE then chances are i am not be able to respond back to rfe or they delay the process of allocating a visa # for my case. In that case i may loose the sept 09 visa availablity for myself to get GC
2. Do not file for AC21 and hope i get my GC. In case they raise RFE I will try to respond and then see what happens.
There is nothing like filing for AC21. If some attorneys do, it is for making some money out of you. Just do nothing at this time. If an RFE comes, get a job offer (if you are already in that job, letter should say that your job will continue upon getting your GC) from your new employer. Job needs to be same/similar to what was described in original LC (there is no clear definition of what is same/similar, but try to have some technical words as in the original LC. IO's are not technical, and they are quite lenient in interpretation of this rule). Anyway, do nothing for now. Just hope for the best.

Dear friends, as I read all of your stories, I cannot help but relate it to mine. Even as I write this though, I am in the middle of a dilemma - I am being offered a promotion to a Director position and I cannot decide whether to accept it or not.
I have been in the US for over eight years on an H1 and have been working for a Fortune 20 firm as a Manager for the last four. My company applied for my Labor Cert back in Dec 2002 and while it cleared State in May 2003, the application was stuck in Federal processing for more than a year. Just as it seemed like they were getting to applications that had been transferred in during May 2003, the BEC took over and I literally felt like the rug had been pulled from under my feet! It's been almost two years since then, but I have seen no progress at all - zero, nada, zilch!
Meanwhile, I have been working hard at my company sorting my way through leadership changes, reorgs and changes in vision and strategy. While all of my colleagues and friends were applying to new positions and getting promoted, I lay low. Four years in the same job - I can tell you that is a looooong time! It isn't just that work starts to become a drag but also life itself seems to be in limbo and the frustration of the wait starts to spill over into personal life.
I got married two years ago and my wife, bless her heart, has been making a valiant effort to keep busy and pursue other interests, since she is on H-4. However, I know she can't wait to start working.
As all of you know, it takes a lot to succeed in the US economy and be recognized, but I have worked hard. Not only have I paid taxes for 8 years, but I also feel like I have paid my dues. I have an MBA from a top b-school and skills that are in demand. I cannot help but wonder, whether we are meant to waste our lives away?? You start feeling like a second-class human. I know I can always go back to my home country but I have invested a lot of my life here. We need justice!
