I had called the congressman from my district (Peter Visclosky) along with the other representatives on the list a few weeks ago. His office had taken my name and address at that time. Today I was surprised to see a letter in mail regarding that conversation and his intention to support the immigration bills in house. So it looks like that the messages we leave with congressional staffers who attend the phones do pass on the message to congressmen.

Come-on members who have not contributed at all. Small donation of $25 or $50 will not hurt your pocket. Only if 2000 members contribute $25/- , it will sum upto 50K.
A small contribution of $50 is nothing, if you care about the cause IV is fighting for. Core members and other senior member are putting their time, money and energy to get relief from this broken EB system. Do your part by making a small donation.
Please, please come forward. Ask you friends to make small contribution.
The sad part is:
About 700-800 out of 3000 have contributed. And they are contributing again and again. Many of them have crossed $500 in personal contributions.
The other 2200 members have contributed nothing

Here is my thought....Lets all start using EAD /AC21. IV should start a campaign that all IV members who have an EAD start looking for a better oppurtunity and use their EAD. Lets say about 10k people have used EAD, USICS just can't deny GC for those 10k people just because they used EAD.
So, lets be bold and start using the EAD. We are not doing anything illegal! It is a legal document and we waited so many years to get the EAD and now keep talking about being on H1B till we get our GC....Comeon people, lets do it in a united way.
Why are we so fearful ? I understand, it is our way of life. But, its enough. Get bold, take risk, worst case, you may have to seek legal help if needed.
Its just a GC, imagine the plight of people who have to go to Iraq/Afganistan, compared to their risk, using EAD is nothing!!!

* Technically and Legally US is a corporation and federal-union not a country (union like UK, ussr, future-EU-federal-state etc). Even india is a union. not a country.
* Your state/UT (DC, PR etc) will be your actual country. All states have their own state-constitution.
Before commenting on the above two points, please take time to watch a great youtube video out there that explains the whole thing based on federal constitution. Search for “citizen 14th amendment” in youtube. When I get home, I will post the link.
Some personal thoughts (not legal technically etc),
* Your loyalty must be concentrated and focused on the state/UT (technically your country) you live. There was a great question asked to Kalam in his recent Seattle visit and his recent speech in WU campus kane hall. He says more than india, even NRI’s (indian citizens) must have loyalty primarily towards the local place they work and live (I assumed, specific to city/region, state/UT).
* be a proud Californian, Texan Etc (ineffect state citizen first before federal or ancestral, ethnical, etc). In effect not indian-american.
Finally I am a US citizen after being 10+ years in this country. This is one of my biggest fulfillments and it means everything to me. US is just not home anymore for me, it is my country.
I wish everyone the best and hope they get GC very soon.

We (employees) didn't write it.
Outsourcing companies didn't write it.

I am desi also, but I hate these consulting companies who do that. I worked my a** off to get a full time job, never faked my resume. People in this forum who blame it on the system are as guilty as the desi companies. Come on people, who are you all kidding, can you commit a crime and balme it on society/system for it? This is the typical of our Indian way of thinking!

Our bill would require every employer to attest that it is not displacing a U.S. worker by hiring an H-1B visa holder and that the employer has taken good-faith steps to recruit U.S. workers for the jobs in which an H-1B visa holder is being sought. Why would anyone oppose this measure? Our bill also gives more oversight and investigative authority to the Department of Labor. Right now the Department may only review labor certification for ``clear indication of fraud and misrepresentation.'' The Secretary of Labor is unable to review applications for anything but what the law calls incompleteness and cannot initiate an investigation unless requested. This means the Labor Department in effect is required to turn a blind eye to information that is suspicious. To remedy this problem, our bill provides the Department of Labor the ability to initiate an investigation on its own and gives the Department of Labor more time to review applications. The Department could also do random audits of any company that uses the program. Aside from these measures, our bill would prohibit employers to only advertise available jobs to H-1B visa holders. It would encourage information sharing between the Department of Labor and the Department of Homeland Security. It would double the penalties for employer noncompliance with the H-1B program requirements. I am happy to report that most of these commonsense solutions were included in the immigration bill. I challenge any of my colleagues to oppose these needed reforms before we talk about increasing the number of H-1B visas or at the very least in conjunction with that process. Today I take the floor to tell my colleagues that I am willing to work on this issue before the end of the year. I know businesses want more visas. I know groups that represent workers and visa holders want reforms. I know the American people want a sensible system in place that gives their children a chance at these highly skilled jobs. Some of my colleagues think the solution is increasing the annual cap on H-1B visas and doing nothing else. Before we agree to import more foreign workers, let's restore integrity in this H-1B program. The system needs a makeover. I am willing to consider an increase in the H-1B visa supply, but only if reforms are included. We must fix the loopholes before we just allow more foreign workers to come in and take jobs that Americans want to do. I would think my colleagues would want this program to work as it was intended by its original authors. My colleagues should want to protect the jobs of our various constituencies and help our businesses find the workers they truly need.

Your attoney should be able to defend your case based on you salary more than PW.
The GC process is for future employement, your bosses ability to pay exists since he has paid you more salary than PW.
Your employer may be making loss every year, but he is paying you more than PW. Now your salary in itself is an expense for employer, so the fact that he is paying you may be making his financials look a little weak in term of profit loss.
Look at other threads on RFE issues, and talk to your lawyer.
I think you are fine.

The conventional wisdom, overall, in DC is that when it comes to Legal EB immigration, Republicans are our friends.
If you are an illegal Democrats are your friends.
These days, the dems and republicans have joined hands against illegal variety. There hasnt been a litmus test of legal immigration on Dems or Republicans. I dont think S 1932 was any indication on where congress stands on our issue. S 1932 was a budget reconcilation bill and they had bigger fish to fry: Budget reconcilation. In order to garner support from their own party, republican leadership had to drop immigration and other non budget related things from 1932. Tancredo and Smith can only have fun as long as there is tough opposition to any bill. On bills of like PACE having 60 senators and hopefully majority on board, Tancredo, Byrd, Smith and cheerleaders like him may not have bargaining power they had during 1932
